1. Purpose
These Terms govern the use of Daigest service (the "Service") operated by Darak (the "Company") and establish the rights and obligations between the Company and users. If you do not agree to these Terms, please discontinue using the Service.
2. Definitions
- Member: Individual or corporate (organizational) user who has registered for the Service through email verification or Google login
- Customer Content: Data provided or integrated by members (e.g., documents, comments, metadata, workspace/channel/repository identifiers from Notion/Slack/GitHub, URL/RSS feeds)
- Document Results: Documents generated and updated by the Service through AI based on Customer Content
- Usage Data (Non-identifiable): Statistics/metadata such as feature usage, performance/error logs that do not identify individuals or business content
- Integrated Services: External sources such as Notion, Slack, GitHub, URL, RSS connected to the Service by members
3. Posting and Modification of Terms
The Company posts the Terms on the website and notifies members 30 days in advance for materially adverse changes, 7 days for general changes. Continued use after the effective date constitutes acceptance of changes.
4. Account and Registration
- Members must provide accurate information and are responsible for account and password management.
- When creating an account on behalf of another person or organization, you must have the authority to represent them.
- Accounts created with organizational email or administrator invitation are subject to organizational policies, and ownership/access rights may belong to the organization.
- Minimum age for service use is 13 years old. Users under 14 require legal guardian consent.
- Members must immediately notify the Company upon discovering unauthorized account access or security breaches.
5. Service Content and Usage
- The Company collects data from integrated services (Notion, Slack, GitHub, URL, RSS) and automatically generates and updates documents through AI services (Google Gemini, etc.).
- Members can configure preferences such as language and timezone, and the service may be temporarily suspended due to system maintenance.
- The Company may add, modify, or discontinue features for service improvement, with advance notice for significant changes.
- Members must comply with the Fair Use Policy (FUP). Abnormal usage such as unauthorized API extensions, automated bot creation, and account sharing is prohibited. Violations may result in account restriction or deletion without prior notice.
6. Prohibited Activities
- Illegal or improper use, identity theft, or misuse of others' payment methods
- Reverse engineering, decompiling, or hacking attempts on the Service
- Abnormal access using automated programs, crawlers, or bots
- Malware distribution, unauthorized access, or causing system overload
- Uploading or posting obscene, vulgar, or violent content
- Uploading copyright-infringing content or violating third-party rights
- Violation of integrated services' (Notion, Slack, GitHub, etc.) terms
7. Data Ownership/Usage Rights
1) Ownership
- Members retain all rights, ownership, and interests in Customer Content and Document Results.
- The Company does not claim ownership of Customer Content or Document Results.
2) Service Operation License (Limited to Necessity)
Members grant the Company a non-exclusive, worldwide, royalty-free license during the contract period to host, store, process, transmit, backup, display Customer Content and Document Results, and create necessary derivative works including AI-generated documents for service provision, maintenance, security, and backup purposes. The Company will not use this beyond the scope of service provision.
3) AI Output and Copyright
AI-generated document results are used at the member's own responsibility. The Company does not guarantee that AI outputs do not infringe third-party copyrights, and members must indemnify and hold the Company harmless from any disputes with third parties arising from the use of such outputs.
4) Model Training
The Company does not use Customer Content or Document Results for model training.
5) Usage Data (Non-identifiable) Ownership
Usage data and aggregate statistics are owned by the Company and may be used for quality improvement, security, billing calculation, and reporting. Reasonable measures are taken to exclude identifying information or business content.
6) Deletion
Upon withdrawal/contract termination, Customer Content and Document Results will be promptly deleted according to these Terms and Privacy Policy, with exceptions for legally required retention (payment/transaction records, etc.).
8. Third-Party Services and Data Storage
Members must comply with integrated services' (Notion, Slack, GitHub, etc.) terms and maintain legitimate access rights. The Company is not liable for restrictions due to third-party reasons such as integration suspension/policy changes unless there is gross negligence.
All data is securely stored in Supabase database located in AWS Northeast Asia (Seoul region). We protect data sovereignty using domestic servers and provide high levels of security and stability.
9. Paid Services and Payment
Fees, billing cycles, and refunds follow the policies displayed in the Service. Fees for already provided periods are non-refundable, and overpayments are refunded through the original payment method. Transaction records are retained for legally required periods.
Members may withdraw from the contract within 14 days of service subscription without providing reasons. However, if the Service was provided during the withdrawal period at the member's explicit request, refunds will exclude amounts proportional to the usage period.
10. Service Termination and Sanctions
- Member Withdrawal: Available through the Service's settings or customer center request. Upon withdrawal, subscriptions and usage rights expire immediately, and member data including Customer Content and Document Results will be promptly deleted (except legally required retention).
- Restriction/Termination by Company: The Company may restrict, suspend, or terminate service without prior notice for providing false information, non-payment, interfering with others' service use, or violating Terms or laws.
- If the same violation is repeated twice or more, or not corrected within 30 days, membership may be revoked.
- No refunds or compensation will be provided for service restrictions due to sanctions.
11. Limitation of Liability
The Company is not liable for indirect, special, consequential damages, data/profit loss, etc., unless there is intent or gross negligence. Liability is exempted in cases of force majeure (natural disasters, etc.).
12. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Korea, and disputes shall be filed with courts according to relevant laws (Seoul Central District Court unless special circumstances such as overseas residence exist).
